Title IX- Perspectives and Practice Tips from the University, Adjudicators and JAMS

In late 2018, we conducted a live training in LA and then recorded and edited that day of training. The resulting videos are fairly long (approximately four hours), and the production values aren’t going to win any Oscars, but it’s a great team of presenters – two JAMS panelists who do Title IX work discussing the perspective from the adjudicator, a Title IX coordinator with terrific training and prosecutorial experience presenting the nuts and bolts and the university perspective , and to speak about the JAMS practice, our own John Pardun.

In fact, John has a note for all of you regarding upcoming training in this growing practice area. As you may know, JAMS has embarked on a new initiative to win the business of higher learning institutions in several ways, with an initial emphasis on Title IX adjudications. These typically arise from allegations of sexual assault and harassment by a complainant, and are performed to determine whether school policy has been broken, and if so, whether a respondent should be sanctioned. Currently, the majority of schools have internal systems in place to address and resolve these sensitive matters that are sub-optimal compared to what we believe JAMS can provide. Our pitch to these schools includes the notion that more experienced individuals, such as yourselves, are needed to render a fairer process; one that is neutral, confidential, and impartial. The timing of this effort is especially good for JAMS, as we have a dedicated resource, Jennifer Sambito, Business Development Manager, tasked with selling our services to universities and colleges. Also, current Title IX current guidance (and soon to be regulation) may result in some schools allowing mediation of these matters under certain circumstances.
